IRS goes after eBay sellers

San Jose, California — As the April 15 deadline for U.S. private citizens to file their 2004 income tax returns draws near, the government is reminding sellers on eBay that they may have to report any proceeds from sales on the auction site as taxable income.

This could be a surprise to some of the 135 million registered eBay users who consider trading on San Jose-based auction site to be a non-taxable hobby. Complicating matters, eBay says it doesn’t report individual sales figures to the government – users are responsible to report any profits on their own tax returns.

The amount of money traveling through eBay is big business. $33.8 billion worth of merchandise was sold on the site in 2004, up from $5.2 billion in 2000.

Although eBay pays taxes on its share of the sales (5.25 percent cut from each transaction as of Feb. 18), the IRS fears some small businesses are using the site to dodge tax responsibility. Adding to the confusion, some sellers may legally be a taxable business without realizing it.

The U.S. Internal Revenue Service has a nine-point checklist it uses to determine whether or not a money-making activity is legally a business, which means money made is taxable, or a simple hobby – where it is not taxable. The IRS can consider a person to be a legal “business” even though they never incorporated or claimed to be one.

According to Woodbury, New York-based accountant Bart Fooden in an Associated Press interview, the IRS looks for such things as evidence that the auction seller depends on the eBay sales income to pay for activities other than maintaining the hobby, acts in a businesslike manner when selling on auctions or puts enough time and effort into the eBay activities that there is an obvious intent to make a profit.

But Fooden said in the same interview casual users probably have nothing to worry about. Those cleaning out closets or the garage and selling off junk for less than the original price paid are not turning a profit, so that money is not considered income and is not taxable.

Al Sharpton speaks out on race, rights and what bothers him about his critics

At Thanksgiving dinner David Shankbone told his white middle class family that he was to interview Reverend Al Sharpton that Saturday. The announcement caused an impassioned discussion about the civil rights leader’s work, the problems facing the black community and whether Sharpton helps or hurts his cause. Opinion was divided. “He’s an opportunist.” “He only stirs things up.” “Why do I always see his face when there’s a problem?”

Shankbone went to the National Action Network’s headquarters in Harlem with this Thanksgiving discussion to inform the conversation. Below is his interview with Al Sharpton on everything from Tawana Brawley, his purported feud with Barack Obama, criticism by influential African Americans such as Clarence Page, his experience running for President, to how he never expected he would see fifty (he is now 53). “People would say to me, ‘Now that I hear you, even if I disagree with you I don’t think you’re as bad as I thought,'” said Sharpton. “I would say, ‘Let me ask you a question: what was “bad as you thought”?’ And they couldn’t say. They don’t know why they think you’re bad, they just know you’re supposed to be bad because the right wing tells them you’re bad.”

Serbian firefighters battling fires in the Kuršumlija area, near the administrative line with Kosovo have reportedly been shot at by Albanians from the Podujevo municipality in Kosovo. Since then, firefighters were denied access to the area.

“Firefighters heard automatic gunfire and temporarily withdrew from the area, while the fire began to spread nearer to the Kuršumlija villages,” a forestry engineer said.

Why Do House Prices Rise And Fall?

Why Do House Prices Rise And Fall? by Ask an economist or realtor this question and he or she will reel off a long list of economic fundamentals” like: Supply and demand Interest rates Immigration Unemployment Economic conditions Cost to rebuild Availability of land Location! Location! Location!Okay, then, in California between 1988 and 1990 house prices rose 50% in most cities. A similar thing happened in New England two or three years earlier, where prices rose up to 75%. In Australia there was an even more stark example house prices doubled, almost country wide, in a 12 to 18 month period from the end of 1987.What caused” these booms? Was there a sudden drop in supply and a huge increase in demand? No. How far did interest rates fall? They rose! Remember those sky high interest rates in 1989? Was there a sudden massive increase in immigration or fall in unemployment? A shortage of land? A rapid inflation in building costs? It was none of these things. It never is a change in economic fundamentals” that causes a boom or bust in house prices, despite what well-meaning economists might tell you via the perhaps not so well-meaning media. You have been dumbed down (conditioned) into believing that the earth is flat when it has always been round. And you never question it.Think about it: If availability of land had anything to do with house prices, how could real estate values fall 80% in Japan in the decade following 1992 or fall 65% in Hong Kong between 1997 and 2002? Those countries have a genuine shortage of land.” And if location is the three golden rules of property investment, then why do some of the best properties fall the most in a bust? There is only one thing that changes whenever there is a boom or bust in house prices. And that is the collective mindset (mood) of the herd.” Humans are driven by an unconscious urge to herd together and all do the same thing at the same time. That’s why they all panic at the same time. Logic and common sense does not influence your decision to buy or sell real estate. Emotion and impulse does. That’s why you often buy at the top. You buy because everybody else is making money” and you don’t want to miss out.” On the way up panic is motivated by greed. Then you sell at the bottom (panic motivated by fear) in case prices fall further.”I often say to my readers, when in doubt there is only one simple rule of investment you need to remember buy when prices are low; sell when prices are high. Yet it is human nature to do the opposite. When house prices are on the bottom and have been nowhere for many years, nobody wants to buy. But once they double in price, everybody wants to buy. I rest my case. How do you break free from a herd of lemmings that might be rushing toward a cliff to commit mass financial suicide? How can you separate yourself from the pack and avoid the mistakes that most investors make? The remarkable thing is that human crowd behavior has a pattern to it and you can learn that pattern. We call it the Wave Principle. The bottom line of a new science called socionomics is: mood governs events and not the other way around. Once the penny drops as to what that means, and you learn how to count the waves, it can be like discovering for the first time in your life that Santa Claus is not true. You have been taught to study the plane. I teach you how to study the pilot. The forecasting record of “The Graham Dyer Newsletter” (since July 1983) puts it at the top of the world pack, including the 1987 stock crash, the Japanese debacle of the 1990s, and the real estate boom this decade, to name just three. Getting even with the law: Wikinews interviews New York City’s ‘Jimmy Justice’

Tuesday, April 22, 2008

“What bothers me is watching an officer write someone a summons and then commit the exact same violation with their official vehicle.

A civilian known as ‘Jimmy Justice’ who resides in New York City (NYC), New York, the largest city in the United States, has been videotaping NYC police officers and city workers, breaking the law while on the job.

Since 2007, he claims to have caught “hundreds of officers and other city employees violating the law,” and says he has them all on camera. He has posted his best confrontations with them to the video sharing website YouTube. As a result, Justice states that he has been asked to do a United States television show and Wikinews got an exclusive interview with him. For protection, Justice wished not to be called by his real name in fear of police retaliation.

Last year, Justice videotaped a police officer parking in front of a fire hydrant, but has only recently gained attention on social networking news sites such as Digg and reddit.com. So Wikinews contacted Mr. Justice, known as JimmyJustice4753 on YouTube, for an exclusive interview to find out what caused him to get revenge on the law.

On June 30, 2007, Justice caught officer E. Anderson of the NYPD, traffic division, parking directly in front of a fire hydrant while she went inside a restaurant to take a 15 minute lunch break.

“Do you think there is something wrong with parking a vehicle, blocking a fire hydrant,?” says Justice while following Anderson to her car after her meal.

“Mrs. Anderson I’m talking to you,” says Justice as Anderson ignores him. “You parked your vehicle blocking a fire hydrant. You are not allowed to do that. Somebody else would get a ticket for that. Why are you allowed to do it? You should be ashamed of yourself Mrs. Anderson.”

By this time, the incident has gained the interest of people nearby the scene and passing it. One unidentified woman, who claims to be a retired NYC police officer decides to intervene stating that people “are not supposed to film any police, [or] anybody employed with the police department because of the terrorism.” A short time later the woman walked off camera.

Since 2007 Justice says he has caught “hundreds of law enforcement officers and city officials” on “over 30 hours of video” violating laws from illegal U-turns in business districts to blocking bus stops and fire hydrants. Justice has only uploaded the “most colorful ones to YouTube” and recently, on April 8, 2008, Justice videotaped a NYPD tow truck officer blocking a hydrant while he also ate lunch inside a restaurant. According to NYC law, it is illegal for any vehicle to park within 15 feet of a fire hydrant and to park in front of a bus stop. It is also illegal for any person to make a U-turn in a business district. Fines for these violations can cost a driver up to US$115.00 for each violation occurred.

When Wikinews asked Justice why he decided to start filming the violations made by officials he answered, “what bothers me is watching an officer write someone a summons and then commit the exact same violation with their official vehicle. I started making these videos to remind the officers (and complacent civilians) that City employees have to abide by the same laws that they are paid to enforce. I plan on doing this and inspiring others to do this as well as a means of leveling the playing field against discourteous officers.”

“In NYC, the traffic cops are notorious for their draconian indiscretion in handing out summonses to civilians for petty violations. Obviously the laws are not enforced as a matter of public safety, but rather to raise revenue,” added Justice.

Justice makes little effort to get the violations on videotape saying “all I have to do to catch them is open my eyes.”

“The problem with abuse of authority is rampant in New York City. I take my video camera with me on the way to work and on the way to social events and band rehearsals and when I see action it takes me less than 4 seconds to have the camera out and in record mode,” states Justice.

His videos have drawn the attention of media and he has been featured on ABC’s ‘I-caught videos’ and Inside Edition. Justice also states that the popularity of his videos have gotten the attention producers in Hollywood, California and as a result, there are plans for a television show.

Since Justice began getting even with officials and their violations, he states that there has been a positive change in the communities.

“The publicity my videos have received has effected positive change in the community, but we still have a long road ahead of us,” added Justice.

As a result of his videos, at the time the NYPD launched an investigation into the violations, but it is not known if any officers were charged or punished. Justice himself has never been arrested, but has been assaulted.

“I have never been arrested for this yet but they have threatened me with arrest. I have been spit on, cursed at, assaulted, and I had 2 cameras broken already,” added Justice.

German polar bear Knut turns one year old

Knut, Germany’s famous polar bear, turned one at the Berlin Zoo yesterday. For the celebration he had a healthy cake with fruits and vegetables, fish and rice on lettuce topped with a candle-shaped rolling pin.

The director of the zoo, Bernhard Blaszkiewitz, said: “I wish Knut that he will get as old as polar bears are supposed to get. So minimum 30 to 40 years, and that he finds a partner.” The way he looks and because he comes from Berlin, he will reproduce well, Blaszkiewitz said. Along with this, he referred to the high birth rate in Berlin.

When Knut was born a year ago, he was rejected by his mother Tosca. Keeper Thomas Dörflein took a parental role and reared Knut by hand. After a few months, Knut grew big and Thomas Dörflein could no longer play with him because he received bad bruises. At birth, Knut weighed 1.8 pounds, today, he weighs 220 pounds. Adult male polar bears can weigh up to 800 pounds.

Knut was the first polar bear born at the Berlin Zoo in 30 years. Millions of people came to see him from all over the world and the event which was dubbed “Knutmania” spawned a CD, a book and hour-long queues at the zoo.

Salvador Sobral wins Eurovision for Portugal

On Saturday, Portugal won its first victory at the Eurovision song competition, held this year at Kiev’s International Exhibition Centre in Ukraine. Salvador Sobral’s song Amar Pelos Dois won 758 points from public and professional judges. Bulgaria and Moldova came second and third respectively. Sobral called it “a victory for music”.

Out of 42 countries participating this time, 26 countries including hosts Ukraine and the Big Five — France, Germany, Italy, Spain and the United Kingdom — competed in the finals. The competition began on May 9. Sobral, who has a serious heart problem, did not perform during early rehearsals. Ukraine, Germany and Spain ended up at the bottom of the vote ranking winning collecting respectively 36, six and five points.

UK representative Lucie Jones secured fifteenth place with 111 points. Sobral’s ballad was written by his sister, who joined the 27-year-old winner on the stage during the reprise. Winner of the second semi-final Bulgaria’s Kristian Kostov secured 615 points from the voting and Moldova won 374 points. Last year, Ukrainian singer Jamala scored 534 points, then highest in the competition, but this year won only 36 points.

Portugal made its first appearance in the competition in 1964. The European Broadcast Union (EBU) warned Sobral against breaking the rules of the contest after he wore a t-shirt with “S.O.S.Refugees” written on it in a press conference following the first semi-final which Portugal had won. The Portuguese said, “If I’m here and I have European exposure, the least thing I can do is a humanitarian message […] People come to Europe in plastic boats and are being asked to show their birth certificates in order to enter a country. These people are not immigrants, they’re refugees running from death. Make no mistake. There is so much bureaucratic stuff happening in the refugee camps in Greece, Turkey, and Italy and we should help create legal and safe pathways from these countries to their destiny countries” EBU banned him from wearing t-shirts with politically motivated messages.

Kasia Mo?, representing Poland, said that she dedicated her performance to animal rights and added “I just hope that after this in Poland we’re going to change the law and we will not have dogs on chains”.

Eurovision reported the final was watched by four million viewers on YouTube.

As the winner of this edition of the competition, Portugal is to host next year’s competition. Two-time winner of the competition Ukraine previously hosted the 2005 contest.

FBI begins widespread financial probe of 26 firms

The FBI is investigating 26 firms and 1,400 individuals involved in the US financial crisis for fraud and “sub-prime lending practices”. Freddie Mac, Lehman Brothers, Fannie Mae and AIG are among the firms being scrutinized after recently receiving federal bailouts.

Investigators, who are cooperating with the IRS, Postal Office, and other federal offices to complete their investigation, are concerned that major corporations may have also forced or bribed ratings agencies to favor them.

The probe, which is in early stages, began eight months ago when the FBI began taking a close look at the mortgage industry and widespread irresponsible loaning practices. At least one corporation has been raided, but so far no evidence of fraud has been found.

The FBI has questioned executives of each of the firms closely, and arrested two in June. An anonymous source told The Times that the firms had been ordered to “hold all papers and e-mails under lock and key” as the FBI scours the finances of each firm.

Many of the companies and individuals being investigated are at the center of the nationwide financial crisis and controversial bailout plans, and have been widely blamed for the country’s financial crisis. The investigation has come at a time when the eyes of many in the US and around the world are turned towards the financial markets, as Congress and politicians scramble to fix the crisis while the election date looms closer.

Officials told CNN that it would be a long time before the investigations were finished, adding a warning: “Don’t expect indictments tomorrow or next week or next month”.
